1. When the present application was taken up on 07.07.2026, the following order was passed:-
“1. Applicant seeks regular bail in case arising out of FIR No. 383/2025 dated 20.04.2025, registered at P.S. Okhla Industrial Area, Delhi, for commission of offences under Sections 115(2)/351(2) of Bharatiya Nyaya Sanhita, 2023 (BNS) and Section 4 of Protection of Children from Sexual Offences Act, 2012 (POCSO).

Learned counsel for applicant submits that the victim-boy has already been examined and in his cross-examination, he has, very categorically, claimed that the applicant and his co-accused were not involved in the offence and rather, the actual perpetrator of the crime was one Deepak, who This is a digitally signed order. is cited as a prosecution witness in this matter. In fact, he happens to be complainant. 3. Learned APP for the State appears on advance notice and accepts notice. 4. Let reply be filed with advance copy to the opposite side before the next date of hearing. 5. Endeavour be made to inform the concerned victim-boy about the pendency of the present bail application, so that his response, through his counsel or guardian, is also appropriately regarded on the next date of hearing.”
2. Learned Addl. P.P. for the State submits that victim has been contacted through his maternal grandmother by the concerned SHO/IO and has been informed about the pendency of the present bail application. 3. There is, however, no representation from his side. 4. The testimony of victim dated 07.05.2026 and 26.05.2026 is already on record. As already noticed above, despite a specific Court question put to the victim, he remained adamant in his stand and claimed that he had implicated the accused herein at the asking of one Deepak. He also revealed that he had been, actually, sexually assaulted by said Deepak only. 5. The case of prosecution is, largely, dependent upon the testimony of victim and, as already noticed above, he has turned the prosecution’s case upside down. 6. There are 25 witnesses in all and, therefore, there is no likelihood of trial getting completed in near future, either. 7. Keeping in mind the overall facts and circumstances of the case, albeit, without expressing any final opinion over the merits of the case, the applicant is, hereby, admitted to bail on his furnishing personal bond and surety bond in a sum of Rs. 25,000/- with one surety each subject to the satisfaction of concerned learned Trial Court/Chief Judicial Magistrate/Duty Judicial This is a digitally signed order.

Magistrate First Class with the following conditions:- (i) Surety shall be local. (ii) Applicant shall not try to contact any witness, directly or indirectly. (iii) Applicant shall furnish a mobile number to concerned IO on which he can be contacted, if required. Such number shall remain operational and functional. (iv) Residential address of the applicant shall be got verified, before releasing him on bail. 8. The application stands disposed of in aforesaid terms. 9. A copy of this order be sent to the concerned learned Trial Court and also to the Jail Superintendent for necessary information and compliance.
