The petitioners are apprehending their arrest in connection with Hirodih P.S. Case No.105 of 2025, for the alleged offences registered under Sections 76, 115(2), 126(2), 117(2), 118(1), 109, 303(2), 351(2), 352 and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned J.M. 1st Class, Giridih. 3. Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in this case and the altercation took place while the other side was cutting the bamboo of the petitioners. He also submits that the injuries have been received by both the sides, however, the petitioners’ side has not lodged the case. He further submits that in identical situation co-accused persons have already been granted anticipatory bail in A.B.A. No.408 of 2026. 2026:JHHC:3341 --2-- A.B.A. No. 660 of 2026 4. Learned counsel appearing for the State opposed the prayer and submit that the allegations are there of assault and pursuant to that the grievous injury has been received by the informant. 5. Considering that identical allegations are there against the petitioners as of petitioners in ABA No.408 of 2026 and all the family members have been made accused and there are general and omnibus allegation of assault against all the accused persons and it is not clear that pursuant to whose assault such injury has been received by the informant and three of the co-accused persons have already been granted anticipatory bail in the aforesaid ABA, I am inclined to provide anticipatory bail to the petitioners. 6. Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned J.M. 1st Class, Giridih in connection with Hirodih P.S.
