ORDER 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 3216/2026 ORDER: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the Petitioners herein/Accused Nos.1 and 2, seeking regular bail, in Crime No. 119 of 2025, dated 15.10.2025, on the file of Prohibition and Excise P.S., Anakapalli, Anakapalli District, registered for the offences punishable under Section 20(b)(ii)(C) r/w 8(c) of Narcotic Drugs and Psychotropic Substances Act (for short “NDPS Act”). 2. Brief facts of the case are that, on 14.10.2025, on credible information. the SI of Prohibition & Excise P.S., Anakapalli secured the presence of mediators and conducted vehicle, checking. While conducting the vehicle checking, the petitioners were caught while transporting 30 Kgs of Ganja. The SI of police seized the contraband and the vehicles under the cover of mediators’ report. Heard Sri Pulapalli Babji, learned counsel for the petitioners and Mrs.K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the 3. State. The learned counsel for the petitioners would submit that the petitioners 4. herein are the accused No.1 and 2. The petitioners are innocent and are no way concerned with the alleged offence. They have been falsely implicated in this case. The A-1 has been in judicial custody since 18.10.2025 and the A-2 4 has been in judicial custody since 15.10.2025. Learned counsel would further nd submit that this is the 2 bait application. The earlier bail application was dismissed by this Court on 21.01.2026 in 12804 of 2025. Learned counsel for the petitioners would further submit that, though, statutory period is already over, no report has been filed before the Special Court till date. Learned counsel further submits that the petitioners undertake to strictly adhere to any conditions that may be imposed by this Court. 5. Learned Assistant Public Prosecutorwould submit that statutory period has been completed. She would further submit that the investigation is still pending and no extension petition is filed before the Special Court for extension of judicial remand. She finally submits that the Court may pass appropriate orders. 6. Considering the submissions made and on perusal of the material on record, since the statutory period has been completed and no report has been filed before the Special Court by the prosecution, this Court is inclined to enlarge the petitioners/Accused Nos. 1 and 2 on bail. 7. In the result, the Criminal Petition is allowed with the following stringent conditions: i. The petitioners/Accused Nos. 1 and 2 shall be enlarged on bail on executing bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each, with two sureties for the like sum each to the satisfaction of the learned I Additional 5 Junior Civil Judge-cum-XI Additional Metropolitan Magistrate, Anakapalli. ii. The petitioners/Accused Nos. 1 and 2 shall not commit or indulge in commission of any offence in future. iii. The petitioners/Accused Nos. 1 and 2 shall cooperate with the investigating officer in further investigation of the case and shall make themselves available for interrogation by the Investigating Officer as and when required. iv. The petitioners/Accused Nos. 1 and 2 shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court. / V. The petitioners/Accused Nos. 1 and 2 shall surrender their passports, if any, to the concerned Court. If they claim that they do not have a passport, they shall submit an affidavit / to that effect to the concerned Court. vi. The petitioners/Accused Nos. 1 and 2, shall appear before the concerned Station House Officer, once in a week i.e., on every Saturday between 10:00 am and 05:00 pm, till further orders. 6 In the event of violation of any of the above conditions, the prosecutio.. 8. shall be at liberty to seek cancellation of bail. It is also made clear that the observations made in this order are only for 9. the purpose of deciding the bail application and they shall not be construed as opinion on the merits of the Crime.
