IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) TUESDAY, THE TWENTY FOURTH DAY OF FEBRUARY TWO THOUSAND AND TWENTY SIX PRESENT THE HONOURABLE SRI JUSTICE NINALA JAYASURYA WRIT PETITION No.25455 OF 2011 Between: 1. Kasi Bala Durga Prasada Rao, S/o.Venkata Rao, Aged 51 years, Hindu, employee in Andhra Paper Mills Ltd., at Rajahmundry (PO) E.G. District, and another ...Petitioners AND 1. The A.P. Eastern Power Distribution Co. Ltd., Rep. by its: The Assistant Engineer, Operation, Section Office, Mummidivaram (PO) & (M), East Godavari District, and three others. ...Respondents Counsel for the Petitioners : Mr.P.Narasimha Rao Counsel for Respondents 1 to 3: Ms.Aishwarya Chowdary, Junior Standing Counsel for APEPDCL 2 The Court made the following ORDER: The grievance of the petitioners in the present writ petition is that the respondent Nos.1 to 3 are laying over-head distribution lines and erecting electricity poles in the subject matter property of an extent of Ac.0.74 cents of coconut gardens covered in Survey No.883 of Chintalameraka area, Mummidivaram (V) & (M), East Godavari District, without obtaining their consent even after raising objections and that the same is illegal, arbitrary etc. 2. Though Ms.P.Vimala, learned counsel representing the petitioners seeks time to secure latest instructions in the matter, this Court, in the light of the order dated 13.9.2011 in I.A. No.2 of 2011 (WPMP No.31341 of 2011), deems it not necessary to examine the matter in detail. Vide the said order, the respondent Nos.1 to 3 are directed not to proceed with the erection of poles and laying of distribution lines through the subject matter property, without following due process of law. However, subsequently the said order was vacated on 03.7.2012. By virtue of the said order containing the reasons for dismissing the I.A. No.2 of 2011, which appears to have not been challenged, the writ petition has practically become infructuous. 3. Hence, the writ petition is closed, however leaving it open to the petitioners to seek recourse to Law, if any cause survives. There shall be no order as to costs. Miscellaneous petition pending, if any, shall stand closed. ____________________ NINALA JAYASURYA,J February 24, 2026 vasu
