For the State Supplementary affidavit filed by the petitioner is taken on record. On the earlier date, serious allegations were made by the learned counsel for the petitioner against the investigating officer who was in charge of investigation of the case. This day, learned counsel for the State submits that case has been withdrawn from the said investigating officer and made over to another officer for investigation. In view of the above, the investigating officer dealing with the investigation shall conduct the investigation in a fair and unbiased manner and shall take the same to its logical conclusion in accordance with law. The allegations made by the petitioner against the erstwhile investigating officer Sub Inspector Sri Mrinmoy Roy shall be looked into by the Deputy Commissioner of Police, South Suburban Division, Kolkata Police, being the 4th respondent herein, who shall assess and enquire into the veracity and genuineness of the allegation and take necessary steps in accordance with law. With the aforesaid directions, the writ petition is disposed of.
There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.) 2
