1. The present petition under Section 9 of the Arbitration & Conciliation Act, 1996 (hereinafter “the A&C Act”) has been filed by the petitioner seeking that the respondents be restrained from encashing/invoking the four Bank Guarantees submitted by the petitioner to the respondent no. 1.
2. After some hearing, it is agreed that if the Bank Guarantees submitted by the petitioner vide order dated 08.07.2026 are sought to be invoked by the respondent no. 1, at least 5 working days notice shall be given by the respondents to the petitioner.
3. It is noticed that an Arbitral Tribunal has already been constituted to adjudicate the dispute between the parties in ARB.P. 1452/2026. In the event of an application under Section 17 of the A&C Act being filed before This is a digitally signed order. the learned Sole Arbitrator, the same shall be decided without being influenced by the ad-interim orders passed in these proceedings.
