1. Petitioner seeks quashing of Original Application no. 32/2026 dated 16.01.2026 under Section 17(4) of the Prevention of Money Laundering Act, recording of reasons dated 05.02.2026 under Section 8(1) of the PMLA and Show Cause Notice dated 06.02.2026.
2. At the outset, both sides submit that the present petition assails an interim order, while during pendency of this petition final order also was passed and the same has been challenged before the Appellate Authority under Section 26 PMLA. In the present petition, main emphasis of the petitioner is that the subject search and seizure were not in accordance with law as the Original Application No.32/2026 was not filed by the person who conducted the search and seizure, so there was a violation of Section 17(4) of PMLA. This contention is disputed by learned Panel Counsel for Directorate of Enforcement. However, it is admitted by both sides that this issue is pending
consideration before the Appellate Authority.
4. In the above backdrop, after addressing partly, learned counsel for petitioner seeks permission to withdraw this petition without prejudice to his
arguments/grounds raised in the present petition, so that the issue involved, especially the alleged violation of Section 17(4) PMLA is decided by the Appellate Authority in the first instance.
5. Accordingly, the present petition is disposed of as withdrawn with the directions to the Appellate Authority to expeditiously decide the appeal filed by the petitioner, including the issue of Section 17(4) PMLA. Accompanying applications stand disposed of.
6. At request of both sides, it is reiterated that all objections, contentions and arguments shall be open to be raised before the Appellate Authority.
