JUSTICE D K SINGH) The present Intra Court appeal has been filed impugning the judgment and order dated 14.08.2024 passed by the learned Single Judge in W.P.No.21514/2024 (KLR-RES) whereby the writ petition filed by the respondent herein has been allowed. The operative portion of the order reads as under:- " ORDER i. The writ petition is allowed. ii. Respondent No.4 is hereby directed to consider the petitioner's representation dated 26.09.2023 and mutate the name of the petitioner in computerized - 3 - HC-KAR NC: 2026:KHC:13843-DB WA No. 877 of 2025 RTC to the extent of 4 acres in Sy.No.14, situated at Guddada beeranahalli Village, Tarikere Taluk, Chikmagaluru District, taking cognizance of existing manual RTC records and all other relevant documents. iii This exercise shall be completed within a period of six weeks from the date of receipt of certified copy of this order." 2. The appeal has been filed along with I.A.No.1/2025 seeking to condone the delay of 233 days in filing the writ appeal, looking at the facts that the petitioner's claim is based on the forged and fabricated record, we condone the delay of 233 days in filing the appeal. I.A.No.1/2025 is allowed. 3. The parties are referred to as per their ranking before the writ Court, for the sake of convenience. 4. Mr. Mohammad Jaffar Shah, learned Additional Government Advocate appearing for the appellants/State submit that the grant, on the basis of which the petitioner is claiming right over the land in question appears to be a - 4 - HC-KAR NC: 2026:KHC:13843-DB WA No. 877 of 2025 forged document, as it is clear from the revenue register that no committee meeting had taken place to grant the land in question in favour of the petitioner. It is further submitted that the handwritten Pahanis from 1996 to 1997 and 2001 to 2002, and suguvali chits are not genuine, but forged and fabricated records. It is further submitted that these facts were not placed before the learned Single Judge while allowing the writ petition by giving direction. 5. As new facts have come on record in the present appeal, it would be appropriate for the appellants/State to seek review of the impugned judgment and order passed by the learned Single Judge. Besides seeking review of the impugned judgment, the appellants may also take appropriate remedy as may be available to them under the law. 6. Therefore, we dispose of this writ appeal with liberty to the appellants/State to file review petition before the - 5 - HC-KAR NC: 2026:KHC:13843-DB WA No. 877 of 2025 learned Single Judge seeking review of the judgment and order dated 14.08.2024 passed in W.P.No.21514/2024. 7. In view disposal of the appeal, pending interim applications, if any do not survive for consideration, hence stand disposed of.
