By way of this writ petition, the petitioner has, inter alia, prayed for the following reliefs:- “i) Issue a writ of Certiorari, Mandamus or other appropriate writ Order or direction quashing the Order/letter dated 25.07.2025 (Annexure P-12) and 17.09.2025 (Annexure P-15) issued by Respondent no.1, being unlawful, arbitrary, without any authority, contrary to the Notification dated 10.04.2025 (Annexure P-10) for all intents and purposes. ii) Issue a writ of Certiorari, Mandamus or other appropriate writ Order or direction, directing the Respondents to pay the revised pay-stipend @ of Rs.1,00,000/- per month in favour of the Petitioner, on the post of Tutor Specialist (Microbiology) in the Department of Microbiology at Pt. Jawahar Lal Nehru Government Medical College Chamba, District Chamba, Himachal Pradesh, in terms of Notification dated 10.04.2025 (Annexure P-10) from the due date i.e. 10.04.2025, along with arrears within a time bound manner, for all intents and purposes. 1 Whether reporters of the local papers may be allowed to see the judgment? iii) Issue a writ of Certiorari, Mandamus or other appropriate writ Order or direction directing the Respondent no.3 to consider the case of the Petitioner for service benefits w.r.t. the Winter as well as Summer vacation roster as is being granted to other Sr. Residents/Tutors specialist in the College, without any discrimination and pay arrears towards 3% hike in pay, every years, upto date. iv) Issue a writ of Certiorari, Mandamus or other appropriate writ Order or direction, directing the Respondents to refund the amount recovered from the petitioner, during the pendency of the CWP with 12%.” 2. Learned counsel for the petitioner submitted that the issue raised in this petition is no more res integra and stands decided by this Court on 12.05.2026, in terms of CWP No. 15274 of 2025, titled as Mrs. Madhuri vs. The State of Himachal Pradesh and others. 3. In light of the fact that the issue raised in this petition is squarely covered by the judgment passed by this Court in CWP No. 15274 of 2025, titled as Mrs. Madhuri vs. The State of Himachal Pradesh and others (supra), this petition is disposed of by quashing order dated 25.07.2025 (Annexure P-12) and order dated 17.09.2025 (Annexure P-15), and by holding the act of the respondents of not paying to the petitioner the revised stipend as from the date of issuance of notice/notification dated 10.04.2025 to be bad in law, with further direction to the respondents to pay revised stipend for the petitioner for the post of Senior Resident/Tutor Specialist (direct)(Microbilogy) w.e.f. 10.04.2025 …2…2026:HHC:26137 ) onwards.
