This is First anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.477/2025 registered at Police Station – Sakti, District-Sakti (C.G.) for the offences punishable under Sections 115(2), 64(1) of BNS,

Prosecution case in brief is that on 17.12.2025, when the prosecutrix had gone to the field to pass urine at the same there is an allegation that accused committed molestation and try to outrage her modesty, It is further alleged that when another woman Madhuri Bai Chauhan VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.02.10 17:27:13 +0530
2 came to intervene and save her, he was also assaulted. Hence, this bail application.

Learned counsel for the applicant submits that the applicant has been falsely implicated and has not committed any offence. It is contended that the applicant is a mentally ill and handicapped person and, therefore, incapable of committing the alleged offence. It is further submitted that the prosecutrix is aged about 70 years and no injury was found on her body as per the MLC report. The applicant has no criminal antecedents and the trial is likely to take time; hence, prayer for grant of bail has been made. 4. Per contra, learned State Counsel has opposed the bail application. She submits that as per the statement of the prosecutrix recorded under Section 183, when the prosecutrix had gone for a nature call, the applicant attempted to outrage her modesty. It is further alleged that when another woman, namely Madhuri Bai Chauhan, intervened to save the prosecutrix, she was also assaulted. Learned State Counsel submits that considering the nature and gravity of the offence, the applicant is not entitled to be released on bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Upon due consideration of the submissions made by both the parties and on perusal of the material available on record, this Court finds that there are specific allegations against the applicant regarding an attempt to outrage the modesty of an elderly woman and assault upon another intervening woman. At this stage, the allegations cannot be brushed aside merely on the ground that no external injury was found on the prosecutrix. The nature of the offence and
3 the manner in which it is alleged to have been committed do not warrant grant of bail at this stage. Considering the seriousness of the allegations and the overall facts and circumstances of the case, this Court is of the opinion that the applicant has failed to make out a case for grant of bail. 7. Accordingly, the anticipatory bail application of the applicant– Manmohan Jaiswal filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.477/2025 registered at Police Station – Sakti, District-Sakti (C.G.) for the offences punishable under Sections 115(2), 64(1) of BNS, 2023., is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
