Though learned Counsel Mr. D.S. Khushalani has filed his appearance for non-applicant No.1, he remained absent. Non-applicant No.2-Driver and non-applicant No.4-Owner of the offending vehicle are served by paper publication, but they did not appear in the matter. Non- applicant No.3 is already deleted from the array of the non-applicants/ respondents. 03. By the present application, the applicant-Insurance Company seeks condonation of delay of 76 days in lodging the appeal against the judgment and award dated 08/01/2019 passed in M.A.C.P. No.304/2010 by the learned Member, Motor Accident Claims Tribunal, Amravati. According to the applicant-Insurance Company, the delay was caused due to administrative exigency and communication gap between the authorities, which appears to be bona fide and justifiable.
