The petitioners herein are aggrieved by the determination of compensation in terms with Section 3G(1) of the National Highways Act, 1956 by the respondent No. 5 who is the Competent Authority for Land Acquisition without taking into account the value of the houses and other immovable properties standing on the land. 3. It is the opinion of this Court that the petitioners have an alternative and efficacious remedy in terms with Section 3G(5) of the National Highways Act, 1956 and as such, this is not a fit case in which this Court should entertain the writ petition by issuing notice. 4. Accordingly, the instant writ petition stands dismissed. 5. It is, however, made clear that the instant writ petition is dismissed on the ground that the same is not being entertained in view of the availability of an alternative and efficacious remedy. 6. The dismissal of the writ petition shall not prejudice or preclude the petitioners from seeking a reference in terms with Section 3G(5) of the National Highways Act, 1956 before the

It is relevant to take note of that the learned Arbitrator shall consider the same within the purview of Section 3G(7) of the National Highways Act, 1956 read with Sections 26 to 30 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and also keeping in mind the observations of the Supreme Court in the case of National Highways Authority of India Vs. P. Nagaraju @ Cheluvaiah & Another reported in (2022) 15 SCC 1.
