Mattegunta.Sudhir,Standing Counsel For Z.P.Ps,M.P.Ps,Gram Panchayats The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue a Writ Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents particularly Respondent Nos 3 4 and 5 in interfering with the peaceful possession and enjoyment of the petitioner over the site admeasuring 1936 square yards in Survey No 90 of Mannetikota Village Ulavapadu Mandal Prakasam District in threatening the petitioner to settle the civil dispute pending in O S No 148 of 2026 on the file of the Court of the Principal Junior Civil Judge Kandukuru in entering the petitioners site on 17 04 2026 in threatening him with false cases and in demolishing a part of the boundary wall as illegal arbitrary unconstitutional without jurisdiction and violative of Articles 14 21 and 300A of the Constitution of India and consequently direct the respondents3 to 5 not to interfere with the petitioners peaceful possession and enjoyment of the subject property except by due process of law ….” 2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader. 3. Sri Paleti V.R. Maheswara Rao, learned counsel for the petitioner, submits that Respondent Nos.3, 4 and 5 are interfering with the peaceful possession and enjoyment of the petitioner over the site admeasuring Ac.1936 sq. yds. in Survey No.90 of Mannetikota Village, Ulavapadu Mandal, Prakasam District, by threatening the petitioner to settle the civil dispute pending in O.S. No.148 3 Dr. YLR, J W.P.No.10933 of 2026 Dated 01.05.2026 of 2026 on the file of the Court of the Principal Junior Civil Judge, Kandukuru, and by entering the petitioner’s site on 17.04.2026, threatening him with false cases and demolishing a part of the boundary wall. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that complaints were received from villagers regarding unauthorized constructions on Government land (Sub-Station land) in the subject survey number, giving rise to tension and apprehension of breach of peace. In view of the same, the Tahsildar, Ulavapadu (Respondent No.4), being the competent authority, requested the police to provide bandobast, and accordingly Respondent No.3, along with police staff, visited the site purely as a preventive measure to maintain law and order. It is further submitted that the police acted strictly in discharge of their statutory duties, in a neutral manner, without favouring any party or interfering in the civil dispute pending before the competent Court. 5. Having regard to the entire facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of, directing the Respondent No.3 not to interfere henceforth in the civil disputes pending between the petitioner and the unofficial respondents, without following due process of law. 6. In the result, the Writ Petition is disposed of.
