HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 35254 of 2026
Court No. - 68 (Sr. No.31 out of 190) HON'BLE KRISHAN PAHAL, J.
1. List has been revised. 2. Heard Ms. Samriddhi Upadhyaya, learned counsel for the applicant, Sri Kailash Chaudhary, Advocate holding brief of Sri Sudhir Kumar Tripathi, learned counsel for the informant as well as Sri Abhishek Mishra, learned A.G.A. for the State. 3. This is the second bail application on behalf of the applicant. The first one was rejected by this Court vide order dated 13.10.2025 passed in Criminal Misc. Bail Application No.30598 of 2025. 4. The present bail application has been filed by the applicant in Case Crime No.206 of 2024 (Sessions Trial No.1519 of 2024), under Sections 498A, 304B, 302, 120-B I.P.C. and Section 3/4 of Dowry Prohibition Act, Police Station Paniyara, District Maharajganj with the prayer to enlarge him on bail. 5. As a new ground, learned counsel for the applicant has stated that the applicant is languishing in jail since 18.06.2024 and there is no likelihood of conclusion of the trial in the near future. As such, the fundamental right of the applicant guaranteed under Article 21 of the Constitution of India stands violated. It is further stated that the statement of PW-1 does not corroborate the prosecution story. Even the post-mortem report does not support the allegations made against the applicant, as only one injury was found to have Versus Counsel for Applicant(s) : Sadhna Upadhyaya, Samriddhi Upadhyaya, Sant Sharan Upadhyay Counsel for Opposite Party(s) : G.A. Ajay Paswan .....Applicant(s) State of U.P. .....Opposite Party(s)
been sustained by the deceased. It is further submitted that the applicant has no criminal antecedents. He is ready to cooperate with the trial and, in case he is released on bail, he will not misuse the liberty of bail. As such, he is entitled to be released on bail. 6. Learned counsel for the applicant could not produce any new ground for pressing the instant bail application except the period of incarceration undergone by the applicant, as such, I do not find it a fit case for grant of bail to the applicant. The instant bail application is found devoid of merits and is, accordingly, rejected. 7.
However, it is directed that the aforesaid case pending before the trial court be decided expeditiously, in accordance with law, without granting unnecessary adjournment to either party, if there is no legal impediment. 8. It is clarified that the observations made herein are limited to the facts brought in by the parties pertaining to the disposal of bail application and the said observations shall have no bearing on the merits of the case during trial.
