The applicants have filed this application for condonation of delay of 162 days in filing the second appeal. The learned Counsel for the applicants has stated that the applicants are from Buldhana district. The Counsel who was appearing for the applicants in trial Court and Appellate Court has informed them that he will not be appearing in High Court and, therefore, they have to engage the Counsel from Nagpur. Due to their financial condition, they could not approach the proper Advocate within time and, therefore, there is delay. 2. The learned Counsel for the respondent No.1 objected to condone the delay as financial problem cannot be a ground for condonation of delay and the ground raised by the applicants is not sufficient to condone the delay. 3. Heard the learned Counsel for the parties and perused the record. 4. Considering the reasons given in the application, the delay of 162 days is condoned subject to 2026:BHC-NAG:10929 2 cas860.2026 costs of Rs.5,000/- to be paid to Public Welfare Account maintained with Union Bank of India, High Court Branch, Civil Lines, Nagpur, bearing Account No. 129712010001014 and IFSC Code UBIN0812978.
