[2026:RJ-JP:35107] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 11886/2026 CNR: RJHC020708132026 | URN: CRLMB / 21876U / 2026 Tofik S/o Usman, Aged About 34 Years, R/o Raniyala (Patakpur), Police Station Pinangwan, District Nuh (Haryana). (At Present Accused Is Confined In District Jail Deeg). ----Petitioner Versus 1. State Of Rajasthan, Through Pp 2. Istak S/o Sher Mohammad, R/o Village Bilag, Kama District Bharatpur. ----Respondents For Petitioner(s) : Mr. Arafat Hussain For Respondent(s) : Mr. Amit Kumar Gupta, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 01/09/2026 1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.34/2020 registered at Police Station Chandwaji, District Jaipur Rural for offences under Sections 395, 365 and 342 of IPC. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that though there is an allegation against the present petitioner of having committed the robbery, it is evident from a perusal of the record that the petitioner was not identified during the Test Identification Parade. He further submits that the co-accused, [2026:RJ-JP:35107] (2 of 2) [CRLMB-11886/2026] Sahukar, has already been enlarged on bail by a Coordinate Bench of this Court vide order dated 12.12.2022, whereas the co- accused, Jamshed @ Jammi, has also been enlarged on bail by a Coordinate Bench of this Court vide order dated 28.05.2021. It is further submitted that the petitioner has been in custody since 03.06.2026 and the charge-sheet has already been filed. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, consequently, the bail application deserves to be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submissions and material available on record and in light of submissions made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Tofik S/o Usman, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
