1. The petitioner has filed this writ petition seeking for the following reliefs.
“i. To kindly call for the records of the case from the respondents. ii. To kindly direct the respondents to decide the representation of the petitioner keeping in view the relevant rules and legislation for the purpose. iii. To kindly direct the respondents to release/disburse the family pension due to the petitioner. iv. To kindly direct the respondents to release/disburse the death cum retiral dues pending for the petitioner and dependent family. v. To kindly make any other order that may be deemed fit and just in the

Learned counsel for the petitioner submits that the husband of the petitioner namely late Shri Ashok Chaturvedi was working as Assistant Development Extension Officer, Janpad Panchayat, Arang, District Raipur (C.G.). He was placed under suspension on 12.07.2019. Though a departmental inquiry was initiated against him, the same was not concluded. Unfortunately, during the pendency of the said proceedings, he expired on 11.04.2021. After the death of her husband, the petitioner submitted representations to the respondents for payment of admissible dues including family pension, gratuity and other retiral benefits. Since no action was taken on her request, the petitioner has approached this Court by filing the present writ petition seeking the aforesaid reliefs. 3. Return on behalf of the respondents has been filed. Learned counsel for the respondents submits that late Shri Ashok Chaturvedi was convicted in Criminal Case No. 8488/2018 vide judgment dated 29.11.2019 passed by the Judicial Magistrate First Class, Raipur, District Raipur (C.G.) for offences punishable under Sections 420 and 325 of the Indian Penal Code. The appeal preferred against the said conviction was dismissed and a criminal revision against the same is pending before this Court. On the said basis, it is contended that the petitioner is not entitled to the claimed dues. 4. Today, learned counsel for the petitioner placed on record a communication issued by the Under Secretary, Government of Chhattisgarh, Panchayat and Rural Development Department addressed to the Additional Development Commissioner, Office of the Development Commissioner, North Block, Sector-19, Nava Raipur Atal Nagar, District Raipur (C.G.), dated 01.09.2025 the relevant portion of which reads as under:

On instructions, Mr. Gupta submits that the aforesaid communication has indeed been issued by the Under Secretary to the Additional Development Commissioner. 6.
Learned counsel for the petitioner submits that in view of the decision taken by the State Government to pay the legally admissible dues of the deceased employee to the petitioner, the present writ petition may be disposed of with a direction to the respondents to act in accordance with the said communication and release the admissible dues within a reasonable period.
7. I have heard learned counsel for the parties and perused the record.

In light of the aforesaid facts and circumstances, the writ petition is disposed of at this stage with the expectation that the respondents shall adhere to the communication dated 01.09.2025 and proceed to release and pay the admissible dues to the petitioner within a further period of 90 days from the date of receipt of a copy of this order. In case any cause of action survives or any eventuality arises, the petitioner shall be at liberty to avail appropriate remedy in accordance with law.
9. With the aforesaid observations and directions, the writ petition stands
