C.R.M.(A) 426 of 2026
In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Debra P.S case no. 226 of 2025 dated 28/3/2025 under Sections 316(2)/316(5)/318(2)/318(4) of the BNS. In the matter of: Dipankar Banerjee ...Petitioner. Mr. Kalyan Kr. Chakraborty Mr. Gopal Krishna Sarkar Mr. K. Bhattacharyya …for the petitioner. Mr. Ranadeb Sengupta Ms. Eshita Dutta …for the State.
1. Learned counsel appearing for the petitioner submits as follows. The de-facto complainant of the case is the Area Manager of a finance company who was in-charge of five branches. The petitioner was the Manager of such branch. He was to collect the money from the investors through the employees of the company and then deposit to the Area Manager. Some employees are now falsely implicating the petitioner by stating that they had given some money to the petitioner who did not hand it over to the Area Manager.
2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He relies on the statements of witnesses and other documents available in the case diary. However, there is no statement of any investor that the money was paid to the petitioner.

3. Considering the above and the other materials available in the case diary, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner.
4. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall cooperate with the investigation and shall not threaten or intimidate the witnesses. The petitioner shall meet the I.O once a fortnight till submission of report in final form.
5. Accordingly, the application for anticipatory bail is allowed.
6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
