JUSTICE ARUN KUMAR JHA ORAL ORDER 2 12-05-2026 The matter was heard via video conferencing mode. 2. Heard learned counsel for the petitioner and learned A.P.P. for the State. 3. In the present case, the petitioner seeks bail in connection with Gaunaha P.S. Case No. 177 of 2025, dated 09.12.2025, registered for the offences punishable under Sections 126(2), 115(2), 118(1), 352, 351(2), 110 and 74 read with Section 3(5) of the B.N.S., 2023. 4. As per the prosecution case, petitioner and other co-accused persons came to the doors of the informant and assaulted the informant, her husband and also their son causing a number of injuries to them. 5. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. He has not committed any Patna High Court CR. MISC. No.32480 of 2026(2) dt.12-05-2026 2/3 offence and no offence in the manner as alleged has ever taken place. The occurrence took place on 12.11.2025 and FIR has been lodged on 09.12.2025. Both the parties are family members and the informant of this case is wife of the brother of the petitioner. There is counter version and Gaunaha P.S. Case No. 184 of 2025 has been instituted by the petitioner’s side agaisnt the informant and others. The injury received by the informant, her husband and their son are non-serious and no injury of any sharp weapon has been found which falsifies the allegation against this petitioner that he gave a tangi blow on the husband of the informant. The injury report of the husband of the informant shows only lacerated wound on occipital region of size 1” x 1/4”. However, allegations against the petitioner are non-specific, general and omnibus with other co-accused persons. Learned counsel next submits that petitioner is having clean antecedent and chargesheet has been submitted. Learned counsel lastly submits that petitioner is in custody since 18.01.2026. 6. Learned A.P.P. appearing on behalf of the State opposes the submissions made on behalf of the petitioner and submits that fardbeyan was recorded on 13.11.2025, but FIR has been registered on 09.12.2025. 7. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the Patna High Court CR. MISC. No.32480 of 2026(2) dt.12-05-2026 3/3 absence of injuries attributed to the petitioner and also considering his period of custody and submission of chargesheet, the petitioner, above-named, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st, Bettiah, West Champaran, Bihar / concerned Court, in connection with Gaunaha P.S. Case No. 177 of 2025, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioner. (ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial Court. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned.
