By this application, filed under Section 483 of the BNSS, 2023, the petitioner, namely, Smti. Jyotsna Sahani, has prayed for release on bail after she was arrested in connection with NDPS Case No. 104/2025 arising out of Bongaigaon GRPS Case No. 68/2025. The case has not been charghseeted and has been registered as NDPS Case No. 104/2025 pending in the Page No.# 2/2 court of the learned Sessions Judge, Bongaigaon. The petitioner was in the company of another couple. From all of three 34 kgs. of ganja and individually 12 kgs of ganga were recovered from the present petitioner. The present petitioner is a disabled woman. Her disability certificate is filed with the present bail application. She has already spent 8 (eight) months in judicial custody and only 1 (one) Prosecution Witness has been examined by the trial court. Considering the above, this court is of the opinion that the present petitioner is no longer deserved to be detained in custody. Hence, her prayer for bail is allowed. Accordingly, the petitioner Smti. Jyotsna Sahani, who was arrested in connection with NDPS Case No. 104/2025 arising out of Bongaigaon GRPS Case No. 68/2025, is allowed to go on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Sessions Judge, Bongaigaon.
