The petitioners seek transfer of proceedings arising out of FIR No. 20/2023 dated 20.03.2023, registered at Police Station Crime (Women) Cell, Nanak Pura, under Sections 498A/406/34 of the Indian Penal Code, 1860 [“IPC”], which are presently pending before the Mahila Court, South-West District, Dwarka Courts, New Delhi, to the competent Court at Saket Courts, New Delhi. 2. Mr. Shikhar Goel, learned counsel for the petitioners, states that other proceedings between the parties are pending before the Mahila Court, South District, Saket Courts, which include two petitions under Section 12 of the Protection of Women from Domestic Violence Act, 2005, one instituted by petitioner No. 4 [mother of petitioner No. 1], and the other by respondent No. 2. The petition also discloses that certain other proceedings are pending before the Family Court, South District, Saket. 3. TR.P.(CRL.) 59/2026 noted Mr. Goel’s submission that arguments on charge are already part- heard before the Mahila Court, Dwarka Courts, and that the petitioners are agreeable to the transfer of the proceedings after the stage of framing of charges. 4. In view of the fact that several proceedings between the parties are pending before the Mahila Court, South District, Saket Courts, Ms.Gayatri Puri, learned counsel for respondent No. 2, states that respondent No. 2 has no objection to transfer of the proceedings to the said Court, after the stage of framing of charges. 5. Mr. Hitesh Vali, learned Additional Public Prosecutor for the State, also does not object to the same. 6.
For the aforesaid reasons, the petition is disposed of, with the direction that the Mahila Court, South-West District, Dwarka Courts, New Delhi, will proceed to complete the arguments on charge, and after the stage of framing of charges, if any, the proceedings arising out of FIR No. 20/2023 dated 20.03.2023, registered at Police Station Crime (Women) Cell, Nanak Pura, under Sections 498A/406/34 of the IPC, will be transferred to a competent Court in South District, Saket Courts, New Delhi. 7. List before the Principal District & Sessions Judge, South District, Saket Courts, for further proceedings on the date to be notified by the Transferor Court. 8.
