JUSTICE S SUNIL DUTT YADAV ORAL ORDER The petitioner has called in question the validity of the general awards at Annexures-D, E, F and G insofar as the properties of the petitioner in land bearing Sy.No.98/1, 98/2, 98/4 and 76 of Doddagollahalli Village, Kundana Hobli, Devanahalli Taluk are concerned. - 3 - HC-KAR NC: 2026:KHC:22130 WP No. 12514 of 2026 2. It is further submitted that the Court may issue a writ in the nature of mandamus to direct the respondents to consider the petitioner’s representations and pass an award in terms of the agreement as per Section 29(2) of the Karnataka Industrial Areas Development Act, 1966 (for short ‘KIAD Act’) and award compensation by way of developed land in lieu of cash compensation. 3. The case of the petitioner is that he was willing for passing of a consent award and accordingly, the question of passing of general awards does not arise. 4. Learned counsel for the respondent - Karnataka Industrial Area Development Board (KIADB) submits that the petition itself could be disposed of while setting aside the general awards insofar as the petitioner is concerned and the respondent - Special Land Acquisition Officer, KIADB would consider the request of the petitioner and pass a consent award as per law. - 4 - HC-KAR NC: 2026:KHC:22130 WP No. 12514 of 2026 5. The details of general awards are as follows: a. General Award bearing No.KIADB/LAQ/2041/ 2023-24 dated 06.06.2023 in respect of Sy.No.98/1. b. General Award bearing No.KIADB/LAQ/2042/ 2023-24 dated 06.06.2023 in respect of Sy.No.98/2. c. General Award bearing No.KIADB/LAQ/2084/ 2023-24 dated 06.06.2023 in respect of Sy.No.98/4. d. General Award bearing No.KIADB/LAQ/ /2024- 25 dated 29.04.2024 in respect of Sy.No.76. 6. In light of the said stand, taking note of the directions passed in W.P.No.15026/2021, the petition is disposed of as follows: (i) The impugned general awards as detailed above at Annexures-D, E, F and G insofar as the petitioner’s land is concerned, is set aside. - 5 - HC-KAR NC: 2026:KHC:22130 WP No. 12514 of 2026 (ii) The respondent No.3 is directed to consider the claim of the petitioner for passing of consent award and pass a consent award in terms of Section 29(2) of the KIAD Act, within a period of four months from the date of receipt of copy of this order. (iii) The respondent authorities are at liberty to withdraw the amount if deposited before the civil Court. (iv) In the even of any dispute, the general award would revive. 7.
