ORAL ORDER This writ petition is filed by the defendant under Article 227 of the Constitution of India, challenging the
order dated 05.06.2025 passed on I.A. No.8 in O.S. No.383/2020 by the Senior Civil Judge and JMFC, Magadi (for short, “the trial court”), whereby the application filed by the plaintiffs under Order I Rule 10(2) of the Code of

Civil Procedure (for short, “CPC”), seeking to implead the Land Acquisition Officer, has been allowed.
2. For the sake of convenience, the parties are referred to as per their ranking before the trial court.
3. Respondent Nos.1 and 2/plaintiffs filed a suit in O.S. No.383/2020 for specific performance of contract. On the ground that a portion of the suit schedule property has been acquired by the State Government, they filed an application seeking to implead the Land Acquisition Officer.
4. The learned counsel appearing for respondent Nos.1 and 2/plaintiffs submits that only a part of the land has been acquired, and in that regard, the Land Acquisition Officer has already deposited the compensation amount before the Civil Court. What is sought in the application is the impleadment of the Special Land Acquisition Officer. The trial court, after considering the
contentions of the parties, has allowed the impleading application. The Land Acquisition Officer has been made a

party to the suit and has not challenged the same. The impleadment of the Special Land Acquisition Officer will not prejudice the rights of the petitioner/defendant.
5. There is no error or illegality in the order passed by the trial court. The writ petition is devoid of merit. Accordingly, it is dismissed.
