The petitioners are apprehending their arrest in connection with R.C.05(A)/2012-AHD-R, for offence registered under section 420, 423, 424, 467, 468, 469, 471, 477-A, 120B, 109, 201 IPC and sections 13(2) r/w 13 (1)(d) of the Prevention of Corruption (PC) Act, 1988, pending in court of learned AJC-XVIII-cum- Spl. Judge, CBI (Ranchi). 3. Learned counsel for the petitioners submits that the petitioners have cleared the JPSC Examination of the year 2003 and the charge sheet has not been submitted against the petitioners, however, the learned court has been pleased to take cognizance. He next submits that the co-accused persons have been granted anticipatory bail in ABA No.1707 of 2025 and ABA No.5198 of 2025. 4. Learned counsel appearing on behalf of the respondent CBI opposes the prayer and submits that the learned court has rightly taken cognizance, however, he is not disputing the fact that other co-accused persons have been granted anticipatory bail as aforesaid. 5. In view of the above and considering that the charge sheet has already been submitted and there is no chance of tampering with the evidence by the petitioners and the learned court, differing with the charge sheet, has been pleased to take cognizance against the 2026:JHHC:6079 3 A.B.A. No. 995 of 2026 petitioners. There is no doubt that the learned court differing with the charge sheet can take cognizance, however, cogent reasons are required to be there in the order taking cognizance and the co-accused persons have been granted anticipatory bail in the aforesaid A.B.As, I am inclined to grant anticipatory bail to the petitioners. 6. Accordingly, the petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned AJC-XVIII-cum- Spl. Judge, CBI (Ranchi), in connection with R.C.05(A)/2012-AHD-R, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
