[2026:RJ-JP:35468] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous 2nd Bail Application No. 8162/2026 CNR: RJHC020495172026 | URN: CRLMB / 14922U / 2026 Ajay Singhiwal S/o Chotulal, Aged About 28 Years, R/o Opposite Ramdev School, Housing Board, Kishangarh, Police Station Madanganj, District Ajmer. At Present Confined In Central Jail Ajmer ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Ms. Rekha Jain For Respondent(s) : Mr. Jaiprakash Tiwari, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 02/09/2026 1. The petitioner has preferred this second bail application under Section 483 of BNSS in FIR No.291/2025 registered at Police Station Civil Lines, District Ajmer for offences under Sections 103(1), 109(1), 115(2), 191(2) and 3(5) of BNS, 2023. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. The first bail application filed by the petitioner was withdrawn by learned counsel, with liberty to file a fresh application after the filing of the charge-sheet. 4. Learned counsel for the petitioner contends that the petitioner has falsely been implicated in this case. She submits that the main allegation with regard to causing the death of the deceased namely Pinki and Meenakshi, has been attributed to co- [2026:RJ-JP:35468] (2 of 3) [CRLMB-8162/2026] accused Vikas, who was driving the pickup vehicle. She again submits that co-accused Vikas has been enlarged on bail by Co- ordinate Bench of this Court vide order dated 15.05.2026. Other co-accused Hetram, Dasham, Mister and Mukesh also got benefit of bail by Co-ordinate Bench of this Court vide order dated 05.02.2026. She argues that co-accused namely Mukesh, Lakhan, Mangal and Dharma also enlarged on bail by Co-ordinate Bench of this Court vide order dated 27.01.2026. Petitioner is behind the bars since 25.03.2026 without any criminal past. Charge-sheet has already been filed. The statements of material witnesses from PW-1 to PW-3 have already been recorded. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner and on the ground of parity with other co-accused, the bail application deserves to be allowed. 5. Learned Public Prosecutor has vehemently opposed the bail application. 6. On consideration of the rival submissions and material available on record and in light of submission made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 7. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner-Ajay Singhiwal S/o Chotulal, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before [2026:RJ-JP:35468] (3 of 3) [CRLMB-8162/2026] that Court on all subsequent dates of hearing till conclusion of the trial.
