Muzaffar @ Lengru who is in custody since 03.07.2025 in connection Basantrai P.S. Case No. 28 of 2025 for the offence registered under Sections 103(1)/238 of Bhartiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate, 1st Class, Godda, is pressed into motion. The daughter of the informant aged 24 years had gone missing from her house on 03.04.2025. She had been in telephonic contact with the accused, who used to call her from his mobile number 9599601351 by representing himself as one Rezaul Ansari. After the victim girl left her home, she informed her parents on mobile that she had married Rezaul Ansari. Later on, the dead body of the victim girl was found in a sewer at Gaura Hatiya under the jurisdiction of Amarpur Kaithiya on 17.04.2025. It is argued by the learned counsel on behalf of petitioner that he is not named in the FIR and the allegation is directed against one Rezaul Ansari, who had kidnapped the victim girl. There is no direct eye witness to fix the identity of this petitioner. Except for the confessional statement of the accused, there is no other legal evidence against him. There is material difference in the dates in the call detail report. Learned A.P.P. opposed the bail petition. It is submitted that the identity of the petitioner has been established on the basis of the mobile by which he was calling the deceased. The mobile SIM was issued in the name of this petitioner and the said mobile was also seized from him. In order to conceal his identity, he misrepresented himself to be one Rezaul Ansari by changing his name. It was this petitioner, who has eloped with the deceased and had killed her which will be apparent from para 34 of the case diary. Under the circumstance, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner, is hereby, rejected. (Gautam Kumar Choudhary, J.)
