1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:-
“a) Issue a writ in the nature of Mandamus or any other appropriate writ, order, or direction to Respondents to enforce strict compliance with municipal laws by immediately sealing, securing, and relocating the unauthorized structure in form of the temple located in front of set back area of SSC Employees This is a digitally signed order. Cooperative Group Housing Society.; and b) Direct Issue a direction for the Respondents to undertake a courtmonitored, time-bound process for the lawful relocation of the unauthorized structure (temple) and its contents to a legally permissible site. ...”
2. For the reasons stated in the petition, issue notice. 3. Mr. Pant, learned counsel accepts notice on behalf of respondent No.1/DDA and Mr. Pandey learned standing counsel accepts notice on behalf of respondent Nos. 2 and 3. 4. As per the petitioners, the respondent Nos. 2 and 3 have erected a structure in the front of the set back area of the society premises which is illegal and unauthorized. The petitioner No. 2 has also highlighted her medical condition which is being affected by the activities carried out by respondent Nos. 2 and 3 in the society premises. 5. I have heard learned counsels for the parties. 6. I am of the view that if the structure is illegal, unauthorized and contrary to the DDA Bye-Laws as alleged, then it cannot be permitted within the compound of the society.
Hence, the respondent No. 1/DDA shall take appropriate action in accordance with its extant rules and regulations, including the sealing/ demolishing, expeditiously and not later than 4 weeks from today, if the structure is found illegal, unauthorized and contrary to DDA Bye-Laws. 7. A copy of the status report shall be given to the petitioners as well as to Mr. Chandra, learned counsel for the petitioners, at the email ID ambujkc1@gmail.com. 8.
