2. The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Section 392 of IPC and Section 27(1) of Arms Act.

Learned counsel for the petitioner submits that petitioner is innocent and has been implicated in this case only on the basis of confessional statement of co-accused. Learned counsel further submits that the co-accused namely, Sushil Paswan and Sunil Kumar Das have been granted bail by this Court in B.A. No. 12689 of 2021 vide order dated 07.12.2021; and B.A. No. 7778 of 2021 vide order dated 23.08.2021 respectively. He further submits that petitioner is languishing in custody since 22.08.2025; as such, the petitioner may be enlarged on bail. Learned counsel further submits that the petitioner is ready to abide by every condition imposed by this court.
4. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
5. Having regard to the facts of the case and looking the period of custody and also the fact that co-accused has been granted bail; I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner is
directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of Sri Rajeev Kumar Singh, JMFC, Dhanbad in
2026:JHHC:4682 2 connection with Nirsa P.S. Case No. 300 of 2020.
6. It is made clear that the petitioner shall appear on each and every date before the learned trial court and if any adverse report will come against the petitioner, learned trial court shall be at liberty to cancel the bail of the petitioner.
