HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - A No. - 16014 of 2026 Court No. - 32 HON'BLE DINESH PATHAK, J. 1. Heard learned counsel for the parties. 2. At the outset, learned counsel for the petitioner has prayed for and permitted to implead the Commissioner, Saharanpur Division, Saharanpur, as respondent no. 7 in the array of parties of the instant writ petition, during the course of the day. 3. The petitioner is aggrieved by the resolution dated 18.12.2024 passed by the Board of the Muzaffarnagar Development Authority, whereby the petitioner has been terminated from his services. He has also challenged the order dated 25.02.2026, purportedly passed by the Additional Commissioner (Administration) on the representation moved on his behalf against the aforesaid resolution dated 18.12.2024, pursuant to the order dated 30.05.2025 passed by this Court in Writ-A No. 7906 of 2025. A perusal of the alleged order dated 25.02.2026 (Annexure No. 10), reveals that the same is a report submitted by the Additional Commissioner (Administration) to the Commissioner, Saharanpur Division, Saharanpur. However, no final order has been placed on the record passed by the Commissioner, Saharanpur Division, on the representation (in the nature of appeal) moved by the petitioner against the resolution dated 18.12.2024 passed by the Board of the Muzaffarnagar Development Authority. 4. On a pointed query raised by the Court, learned counsel for the petitioner submits that the petitioner has not yet received any order passed by the Commissioner on the said representation. 5. Learned Standing Counsel appearing for respondent nos. 1, 4 and 7 Versus Counsel for Petitioner(s) : Satish Mohan Tiwari, Suhas Subhash Mehta Counsel for Respondent(s) : C.S.C., Rajesh Kumar Pandey Suresh Chandra Joshi .....Petitioner(s) State Of U.P. And 5 Others .....Respondent(s) contends that the representation moved by the petitioner against the Board's resolution dated 18.12.2024 shall be considered and decided by respondent no. 7 at the earliest from the date of receipt of a certified copy of this order. 6. In this conspectus, as above, no useful purpose would be served by keeping this matter pending. Accordingly, this Court deems it appropriate to finally dispose of the present writ petition, without expressing any opinion on the merits of the case, with a direction to the Commissioner, Saharanpur Division, Saharanpur (respondent no. 7) to consider and decide the petitioner's representation (Annexure No. 9), pending consideration before him, by passing a reasoned and speaking order in accordance with law, expeditiously, preferably within a period of two months from the date of receipt of a certified copy of this order. 7. With the aforesaid directions and observations, present writ petition stands disposed of. October 8, 2026 vkg WRIA No. 16014 of 2026 2 (Dinesh Pathak,J.)
