P.P. …...... 02/ 12.03.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 147, 148, 149, 341, 323, 307 and 302 of IPC and Section 17 of C.L.A. Act. 2. Heard, learned counsel for the petitioner learned counsel for the State and have also gone through the impugned order. 3. Learned A.P.P opposes the prayer for bail. 4. The case of prosecution in brief is that brother of the informant was assaulted and killed by the banned organization of P.L.F.I. who were threatening the villagers to cast vote in support of MCC candidates participating in the Mukhiya Election. 5. From the impugned order, I find that the case is of the year, 2011 and the petitioner absconded during the entire investigation. Chargesheet was submitted against him showing him as an absconder and even permanent warrant of arrest was issued on 01.09.2012. 6. Considering the fact that the petitioner was an absconder and he escaped from the rigors of law, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Bano P.S. Case No.04 of 2011, corresponding to G.R. Case No.30 of 2011 and S.T. No.99 of 2012 (A)(S), pending in the Court of learned Additional Sessions Judge-I, Simdega, Jharkhand, stands rejected. 7. Accordingly, the instant bail application is dismissed.
