CORAM :
SRI ANANDA SEN, J.
------ For the Petitioner(s) : Mr. Saurav Arun, Advocate For the State
: Mr. Anil Kumar Singh, AC to GP-I For the Resp. No. 5-6 : Mr. Vijay Shankar Jha, Advocate …......
02 /14.01.2026: Heard learned counsel representing the petitioner and the
learned counsel representing the State.
2. The petitioner was appointed on compassionate ground in Class-IV post. Now he prays that he may been appointed in Class-III post as per the recommendation which was initially made.
3. The facts are undisputed. The father of the petitioner died on 28.07.2007 and thereafter the petitioner applied for compassionate appointment. His case was considered and he was recommended to be appointed in the vacancy in Class-III but the petitioner was appointed on 27.08.2008 as Ward Jamadar which is a Class-IV Post. As the grievance of the petitioner was not

redressed the petitioner approached this Court by filing this writ petition on 11.11.2025 praying that his appointment should be against Class-III post as he was originally recommended.
4. I find no merit in this writ petition on the ground that the petitioner was appointed in the year 2008. He accepted his appointment in Class-IV post and now has raised the dispute by filing this writ petition in the year 2025. Further the issue which the petitioner is raising has been considered by the Hon’ble Supreme Court in “Director of Town Panchayat and Others vs. M. Jayabal and Another” reported in 2025 SCC OnLine SC 2794 in paragraph-11 onwards of the said order. On the point whether dependent of a deceased employee can seek employment on compassionate basis on the higher post or not the Hon’ble Supreme Court turned down the claim holding that compassionate appointment arises out of exceptional circumstances, it cannot used as a ladder to climb up in seniority by claiming a higher post merely on the basis that he is eligible for such post.
5. Further on the point of delay and latches, the Hon’ble Supreme Court in paragraph-15 has held that party approaching the Court with significant delay can be denied the benefit.
6. Thus, considering the aforesaid judgment, I am not inclined to entertain this writ petition.
7. Accordingly, this writ petition is dismissed.
