Also heard Mr. B. Gogoi, learned Addl. Advocate General for the State. By the earlier order dated 02.09.2026 passed in I.A (Civil) No. 2910/2026, the State counsel was permitted to obtain required instructions with regard to the claim of the petitioner as to why the counter signed required by the Director of Tea Tribes and Adavasi Welfare did not signed in the format enclosing the caste certificate of the petitioner and to that extent a direction was issued to keep one seat vacant in the category reserved for TGL/Ex-TGL community in the medical admission for the year 2026. The learned Addl. Advocate General submits on instructions that in so far as the merit position of the writ petitioner/applicant is concerned, under the Page No.# 4/5 category of TGL/Ex-TGL, there are three students who are placed above the writ petitioner/applicant in the said category as per the Assam State Rank. The particulars of the same are enclosed in the communication addressed to the writ petitioner/applicant and the same are placed before the Court. Perusal of the communication reflects that the merit position of the writ petitioner/applicant is at Sl. Even if the petitioner’s certificates are held to be genuine/authentic then also Page No.# 5/5 her case can be considered only after the students of the TGL/Ex-TGL category also placed above the writ petitioner on merit are considered. Therefore the Court is of the view that the interim order passed on the earlier on 02.09.2026 to keep one seat vacant in the TGL/Ex-TGL category is required to enable the respondents to take steps for filling up the seat(s) with candidates who are placed above the petitioner on merits. The interim order therefore stands vacated. The respondent authorities may proceed to fill up the seat under the category of TGL/Ex-TGL as per the merit position of the candidates. Interlocutory application accordingly stands disposed of. The writ petition is however be listed for admission on 30.09.2026. JUDGE Comparing Assistant
