Ganjhu, A.P.P. ------ 06/ 10.02.2026 Heard learned counsel for the petitioner and learned A.P.P for the State. 2. The petitioner is apprehending his arrest in connection with Dhanbad Cyber P.S. Case No. 65 of 2025, registered for the offence under Sections 319(2), 318(4), 336(3), 338, 61(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 66(C)(D) of Information Technology Act, pending in the court of learned Additional District Judge-II-cum- Special Judge (Cyber Crime), Dhanbad. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and the name of the petitioner has come on the basis of confessional statement and even the petitioner was not involved in the alleged crime of syphoning of money. She next submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-19 of the petition. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the petitioner happened to be the accomplish of the apprehended co-accused and allegations are there of posing themselves as Bank officials and sent the link and after obtaining the OTP from the victims, they used to withdraw the money from their accounts. 5. In view of the above, it transpires that the petitioner is the accomplish of the apprehended co-accused. Further the house of the [ 2026:JHHC:3475] -2- co-accused Sachin Rabidas was raided, wherein other accused persons were found present and upon search, altogether 8 mobile phones along with one tab were recovered and as per their confession, it transpires that these accused persons posed themselves as bank officials and sent forged link to the victims and after obtaining OTPs from them, the money is being syphoned by the accused persons. 6. In the attending facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. As such, his prayer for anticipatory bail is rejected. (Sanjay Kumar Dwivedi, J.)
