This bail application has been filed on behalf of Prem Kishore Kumar who is in custody since 26.09.2025 in connection with G.R. No. 730 of 2025 arising out of Jirwabari P.S. Case No. 182 of 2025 for the offence registered under Section 96 of the BNS pending in the Court of learned C.J.M., Sahibganj, is pressed into motion. It is submitted by the learned counsel on behalf of petitioner that as per the FIR itself, age of the victim girl at the time of incident was 17 years and there is an allegation of sexual assault against this petitioner who is a student of B.Ed. college, Sahibganj and has no criminal antecedent. Learned A.P.P. for the State opposed the prayer for bail and submitted that allegation does not include any section other than Section 96 of the BNS, 2023 to suggest that sexual assault was committed by the petitioner. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
