1. Heard Ms. Imlirenla, learned counsel for the Applicant; Ms. V. Suokhrie, learned Additional Advocate General, Nagaland for the Opposite Party Nos. 1, 2, 3, 4 and 5; Ms. Esther, learned counsel appearing on behalf of Mr. A. Zhimomi, learned Standing Counsel for Gauhati High Court Kohima Bench. 2. The instant application under Section 5 of the Limitation Act, 1963 is preferred seeking condonation of delay of 178 (One hundred Seventy- eight) days, which period of delay has occurred in filing the accompanying writ appeal, WA/40/2026 against the Judgment and Order dated 12.12.2025 passed in WP(C)/59/2024. The reasons for the delay of 178 days have been sought to be explained in paragraph 3. 3. We have gone through the statements and averments made in the interlocutory application, including paragraph 3.
The learned counsel appearing for the opposite parties have submitted that if the period of delay of 178 days is condoned for hearing the accompanying appeal on merits, they have no objection. Page No.# 4/4

Having gone through the statements and averments made in the instant application, and the reasons for the delay explained in paragraph 3 thereof, and taking into consideration the submission of the learned counsel for the opposite parties, we are of the considered view that the applicant has made out a case for condonation of the period of delay which has occurred in filing the accompanying writ appeal. 5.
