Affidavit of service filed in Court today is taken on record. 2. The petitioner was an Assistant Teacher of a Secondary School. On attaining the age of superannuation she retired from service on 31st December, 2023. There is a shortfall of 1 month and 20 days in the qualifying service of the petitioner to get the benefit of pension. Due to the shortfall in the qualifying service period, pension has not been paid in favour of the petitioner. The petitioner prays for sanction of pension. 3. Reliance has been placed on paragraph 7(e)(iv) of the West Bengal Recognized Non-Government Educational Institution Employees (Death cum Retirement Benefit) Scheme, 1981 which provides that deficiency of six months in qualifying service of the employees of non Government/ Sponsored/ Aided Educational Institutions/Organizations is condonable. Page 2 4. In terms of the aforesaid memorandum, the shortfall of service of the petitioner for one month and twenty days is liable to be condoned. 5. The concerned District Inspector of Schools is, accordingly, directed to process the pension papers of the petitioner at the earliest by condoning the shortfall in his qualifying service period. 6. The aforesaid respondent shall ensure that the petitioner receives her pensionary dues along with all arrears latest within 30th April, 2026. 7. The writ petition stands disposed of. 8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
