2. It is the grievance of the petitioner that he has been dispossessed and the Birsa Agriculture University has constructed a boundary wall of Horticulture College over the land in question and has taken possession of the same. 77.
4. From the arguments of the parties, I find that the petitioner has already been dispossessed from the land in question. The petitioner is claiming title by way of settlement.
5.
Learned counsel for the State submits that the land is recorded in the name of State and the petitioner has got no title over the said land.
6. Considering the nature of rival claims and in fact the dispute is in respect of establishment of right, title and interest over the property in question, I direct the petitioner to approach appropriate Civil Court for declaration of his right, title and interest over the said property as the same cannot be decided in an application under Article 226 of the Constitution of India.
7. Accordingly, this writ petition is disposed of.
