The present petition has been filed by the petitioner with the following prayer: “It is therefore prayed that, this Hon'ble Court may kindly be pleased to allow this instant petition and quash FIR bearing Crime No.416/2024 dated 13.08.2024 and charge sheet bearing No.185/2025 dated 21.07.2025 filed against the petitioner by the Police Station Kotwali District Durg (C.G.) for commission of offence which is punishable under section 61(2),318(4),338,336(3), 340(2) of B.N.S. Act and set aside the order dated 01.11.2025 passed in RCC Case No.34839/2025, passed by Chief Judicial Magistrate, Durg, District Durg (C.G.), whereby the Magistrate has taken the cognizance of the chargesheet and the entire consequential proceedings, in the interest of justice" 3. At the time of hearing, learned counsel appearing on behalf of the State submitted that, in the present case, the complainant has not been impleaded as a party/respondent, which is a necessary requirement for the proper adjudication of the matter. 4. In view of the aforesaid submission, learned counsel for the petitioner seeks permission to withdraw the present petition, with liberty to file a fresh petition after impleading the complainant as a party/respondent. 5. Accordingly, the present petition is dismissed as withdrawn with 3 liberty to file a fresh petition, subject to depositing a sum of Rs. 1,000/- as cost by petitioner in the Registry of this Court, the same shall be transmitted to the Government Observation Home (Boys), Durg, District- Durg. 6. Certified Copy of Annexures, if any, shall be returned to the learned counsel for the petitioner, after retaining its attested true copy.
