[2] This present writ petition is filed under Article 226 of the Constitution of India seeking the following reliefs: i. Issue Notice upon the Respondents; ii. Call for the records; iii. Issue Rule calling upon the Respondents to show cause as to why the Petitioners shall not be granted Five(5)/Two(2) additional non- compounded increments for having Ph.D/M.V.Sc at the entry level of appointment as Assistant Professor. AND Issue Rule calling the Respondents to show cause as to why the Petitioners No. 3 shall not be granted Three (3) additional non-compounded increments for completing Ph.D while in service. AND Issue Rule calling upon the Respondents to show cause as to why the pay of the Petitioners shall not be refixed upon grant of additional non- compounded increments as per the payer above and the arrears of pay shall not be released in favour of the Petitioners. AND Issue Rule calling upon the Respondents to show cause as to why clause 10 of the Notification dated 01.10.2019 shall not be set aside and quashed and further directions shall not be issued upon Respondents to create provision for award of increments upon acquisition of Higher qualifications like Ph.D, M.V.Sc, etc. iv. And after hearing the parties, be pleased to make the rule absolute. AND/OR Pass any other order/orders as deemed fit and proper.” [3] It is the case of the petitioners that the petitioners herein approached this Court seeking for extension of benefits of non compound incentive increment for entry level recruitment as Assistant Professor with Ph.D degree. Hence this petition. Page 3 of 3 [4] After perusal of the record, it has been seen that one of the petitioners namely Dr. Saurabh Majumder submitted representation along with reminder dated 27th January, 2022, 17th March, 2022, and 21st October, 2022 addressed to the concerned respondents ventilating the grievances of the petitioners. But, till date no positive response has been received by them. [5] In view of the same, without expressing any opinion on merits of the case, this present writ petition is disposed of directing the concerned respondent(s) to consider the matter, more particularly in light of the representation along with reminder dated 27th January, 2022, 17th March, 2022, and 21st October, 2022 filed by the petitioner and take a decision within a period of 03 months from the date of receipt of the copy of this order in accordance with law provided that the petitioners are eligible in this aspect . [6] With the above observation and direction, this present writ petition stands disposed of. As a sequel, miscellaneous application(s), pending if any, shall stand closed. DR.
