This is an application filed under Section 151 of the CPC, 1908, on behalf of the petitioner seeking early hearing of the main petition. 2. The matter is presently listed for 08.09.2026. 3. For the reasons stated in the application, issue notice. 4. Mr Rupal, learned counsel accepts notice on behalf of the respondents and has no objection to the application being allowed. 5. Accordingly, with consent of the parties, the present application is allowed and the matter is taken up for final hearing. W.P.(C) 6936/2026 6. The brief facts of the present case are that the petitioner is a student of MBA (HRD) at Department of Commerce, University of Delhi and has successfully completed first 3 semesters of the said course. 7. However, in his last semester, the petitioner was short of attendance and was consequently debarred from taking the examination. 8. The present petition was filed on 18.05.2026, wherein this Court vide its Order dated 18.05.2026 permitted the petitioner to appear in the examination. 9. However, since the Order of this Court was released at about 3:00 PM and the examination had already commenced at 2:00 PM, the petitioner was unable to participate in one paper namely, Ethics, Corporate Governance and Sustainability. 10. It is stated by Ms. Arora, learned counsel for the petitioner that the petitioner has secured a job, which is subject to the outcome of petitioner’s results and provisional degree. 11. Ms. Arora, learned counsel, also draws my attention to Ordinance X- C of the Delhi University Ordinances, which reads as under:- “The Academic Council may, in exceptional cases grant exemption from the operation of any of the Ordinances governing admission of students, migration, the courses to be pursued by them, attendance at lectures or sessional or other work or the examination of candidates and authorise what is proper to be done instead in such cases, provided that no such exemption and authority shall be deemed to have been granted unless not less than two-thirds of the members present of the Academic Council voted in favour of the motion for such exemption and authority made by, or with the written authority of the Vice-Chancellor; and Provided further that this two-thirds majority voting for the This is a digitally signed order. A perusal of the aforesaid Ordinance X-C shows that the Vice Chancellor/Academic Council can consider the case of the petitioner for shortage of attendance and pass appropriate orders in exceptional circumstances. 13. As per Ms. Arora, in the present case, the petitioner is a topper student and has been securing good academic positions throughout his academic journey. The petitioner has brought many laurels to the Delhi School of Economics in distinct disciplines. He participated in Debates, National level Case Study Competitions, and has excelled these competitions twice. Additionally, the petitioner had also participated at National level Basketball competition representing the Delhi School of Economics and won 2nd position therein. 14. Mr. Rupal, learned counsel for the respondent vehemently opposes the petition and states that in the very first place the petitioner should not have been allowed to participate in the said examinations and in any case, the petitioner was only allowed to participate in the examinations by way of an interim Order passed by this Court as the petitioner was short of attendance. 15. However, I am of the view that the petitioner has secured a job and in case the petitioner is not permitted to complete this course, the job which is provisional and subject to the outcome of final result/provisional degree, will itself maybe cancelled/revoked. 16. In view of the above, the Vice Chancellor of the respondent University is requested to consider this petition as a representation and This is a digitally signed order.
