CORAM: HON’BLE MR. JUSTICE RAJNESH OSWAL, JUDGE.
HON’BLE MR. JUSTICE SANJAY PARIHAR, JUDGE.
ORDER 03.06.2026
01. Issue notice to the respondents.
02. Mr. Ilayas Laway, learned GA appears and accepts notice on behalf of respondents.
03. We have heard learned counsel for the appellant at length.
04. The appellant herein had filed the writ petition bearing SWP No. 2083/2015 for commanding the respondents to allow him to join the services as Washer-man in view of sanction granted by the Government under SRO 43 of 1994 and appointment order issued vide Order No. 399 of 2015 dated
28.05.2015.
05. The learned counsel appearing for the appellant herein submits that a Co-ordinate Bench of this Court earlier had
disposed of the appeal preferred by the respondents, by setting aside the judgment dated 23.09.2015 passed by the
learned writ Court and remitted the matter to the writ court and further respondents were
directed to file reply/objections to the writ petition by or before next date of hearing i.e 02.02.2023. Simultaneously the Co-ordinate Bench had also requested the learned writ court to dispose of the writ petition expeditiously in view of the fact that the dispute pertains to the compassionate appointment preferably by or before 31.03.2023.
06. Learned counsel for the appellant further submits that the writ court instead of deciding the matter itself has relegated the appellant to the Central Administrative Tribunal, Srinagar Bench.
07. We have examined the order impugned and concur with the opinion formed by the learned Writ Court that the dispute raised in the writ petition is service dispute cognizable by the learned Central Administrative Tribunal, as such, we do not find any reason to show indulgence. However, we request the learned Tribunal to decide the TA (writ petition SWP No. 2083/2015) preferably within a period of two months from the date of receipt of this order.
08. Disposed of.
