The FIR in connection with which, the petitioner was arrested and is behind the bars for the last 40 days was lodged by one, Parash Kumar Chettri on 16.07.2026, stating inter alia that the petitioner along with 4 other persons falsely represented some gold as genuine and sold it to the informant and took Rs. 4,00,000/- (Rupees Four Lakhs) in cash from him. The informant later came to know that the said gold was fake and he was cheated. 4. The learned counsel for the petitioner, submits that the petitioner was shown arrest in the instant case on 31.07.2026 and that he is inside the jail for quite some time and that his interrogation is over and as such, he may be allowed to go on bail. 5. Mr. B. Sarma, the learned Addl. Public Prosecutor for the State, submits that the petitioner is a habitual offender and that he had earlier also been found involved in such offences and as such, he has prayed for calling of the Case Diary to see the gamut of the case. 6. On consideration of the submissions made by the learned counsels, more so in view of the fact that, there are other persons involved and that the petitioner has been inside the jail for around 40 days, this Court deems it fit to enlarge the petitioner on bail on furnishing of a bail bond of Rs.
20,000/- (Rupees Twenty Thousand) with one local surety of the like amount to the satisfaction of CJM, Kamrup (Metro) under the following conditions: (i) The petitioner shall positively appear before the Investigating Officer as
Page No.# 3/3 and when call for. (ii) The petitioner shall not hamper and tamper with the evidence of the case, and/or influence the witness connected with the case. (iii) The petitioner shall not leave their residence without prior permission of the Investigating Officer; and (iv) Apart from the aforesaid condition, he shall not associate himself with any such offence, and if it is found to be involved in any such offence, the appropriate authority shall be at liberty to seek cancellation of the bail. 7.
