The petitioner has filed this writ petition seeking following reliefs:- 2 “10.1 That, this Hon'ble Court may kindly be pleased to issue a writ in the nature of mandamus thereby quashing the impugned order dated 19.03.2026 (Annexure P/1) passed by the Respondent No. 3. 10.2 That, this Hon'ble Court may, kindly be pleased to issue an appropriate writ in the nature of mandamus thereby directing the respondents to modify the posting/transfer portion of the promotion order dated 31.12.2025 (Annexure P/2) and retain the petitioner at his present place of posting i.e. District Office, Khairagarh – Chhuikhadan – Gandai (C.G.) on humanitarian and medical grounds. 10.3 That, this Hon'ble Court may kindly be pleased to grant any other/relief’s in favour of the petitioner, which the Hon’ble Court deemed fit and just in the facts and circumstances of the case.” 2. Learned counsel for the petitioner submits that as the Respondent No. 3 while considering the representation submitted by the petitioner against his posting on promotion, while rejecting the representation has observed that looking to the nature of procurement season and the work pressure, change of work place is not possible and therefore, he may be permitted to withdraw this writ petition at this stage with liberty to make fresh representation at appropriate stage and direction be issued to the Respondent No. 3 to take decision on the representation to be submitted at appropriate stage considering the difficulties of the petitioner as mentioned in the writ petition. 3. On the other hand, learned counsel for the Respondents would submit that as petitioner is not pressing this writ petition on merits and is only seeking a direction to the Respondent No. 3 to consider and take decision on the representation, he is having no objection to the limited prayer. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised 3 by the petitioner, this writ petition at this stage is disposed of with liberty to petitioner as prayed for.
