1. In this petition filed under Section 528 of Bhartiya Nagarik Surksha Sanhita, 2023, the petitioner seek a direction for early disposal of Session Trial No. 90/2024 pending before the learned Sessions Judge, District Durg (C.G.).
2. Learned counsel for the petitioner submits that the aforesaid criminal case was registered in the year 2024, but despite the RAVI SHANKAR MANDAVI Digitally signed by RAVI SHANKAR MANDAVI Date: 2026.02.03 20:59:06 +0530
2 lapse of more than 2 years, the trial has not yet been concluded. He further submits that the petitioner is innocent and being falsely implicated in the present offence and even after examination of witnesses the prosecution has failed to establish any case against the petitioner and are therefore unnecessarily delaying the trial, therefore, through this petition, the petitioner seeks a direction to expedite and conclude the criminal case within a stipulated time, without challenging any specific order.
3. Learned State counsel opposes the submission made by
learned counsel for the petitioner.
4. I have heard learned Counsel appearing for the parties and perused the documents annexed with the petition including the
order sheets of the Trial Court.
5. Section 528 is engrafted to allow the High Court to intervene in cases where there is a clear abuse of process or where it is necessary to prevent injustice. It is not meant to manage the trial process and specific timelines for disposal. Therefore, I am not inclined to direct the trial Court to expedite and conc lude the trial in a time bound manner.
6. Accordingly, the instant petition is hereby dismissed at motion stage itself. Sd/-
