HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT TAX No. - 4124 of 2026 Court No. - 53 HON'BLE VIKAS BUDHWAR, J.
1. Heard Sri Anurag Pratap Singh, learned counsel for the petitioner and Shri Shashi Kant Mishra, learned Standing Counsel for the respondents. 2. A joint statement has been made by learned counsel for the rival parties that they do not propose to file any affidavit and the petition be decided on the basis of documents available on record. 3. With the consent of the parties, the petition is being decided at the fresh stage. 4. The case of the petitioner is that the petitioner happens to be a firm registered under the U.P. Goods and Services Tax Act, 2017. A show cause notice came to be issued on 20.12.2023 by the Assistant Commissioner, Commercial Tax Department, State Tax, Sector-5, Prayagraj, U.P. under Section 73(1) of the Act for the Financial Year 2018-19 in DRC-01 for demanding Rs. 5,91,64/- as tax, Rs. 4,97,18/- as interest and Rs. 20,000/- as penalty. It is also the case of the petitioner that though the show cause notice came to be issued on 20.12.2023, however, due to negligence of the Chartered Accountant and the Advocate, the petitioner could not present himself on the date of hearing and thereafter, a reminder came to be issued on 08.02.2024, scheduling the date of hearing on 23.02.2024. It is also the case of the petitioner that the show cause notice was transmitted in View Additional Notices and Orders section and as such the reply could not be filed. The second respondent proceeded to pass the assessment order creating a demand Rs.63,096/- as tax, Rs.56,692/- as interest and Rs.20,000/- Versus Counsel for Petitioner(s) : Anarannaj Pratap Singh Counsel for Respondent(s) : C.S.C. M/S Kesarwani Traders .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s)
as penalty. The writ petitioner preferred an appeal against the said order before the appellate authority on 02.01.2026 along with delay condonation application, which came to be rejected by virtue of order dated 04.02.2026 passed by the Additional Commissioner, Grade-II (Appeal), Zone-1, State Tax, U.P., Prayagraj. 5. Questioning both the orders, the present petition has been preferred. 6. Learned counsel for the petitioner, as per instructions received from his client, is confining his relief at this juncture to the order dated 04.02.2026 passed by the respondent no. 3 dismissing the appeal on the ground of delay.
It is contended that a specific ground disclosing the reasons for delay was taken but the same has not been considered and brushed aside. 7. Sri Shashikant Mishra, on the other hand, submits that though the appellate order is not happily worded, but admittedly there is a delay. However, according to him, propriety demanded that the order impugned ought to have been passed after considering the contention raised therein. 8. I have heard the counsel for the parties and perused the record carefully. 9. Apparently, an ex-parte order came to be passed on 16.04.2024 by the respondent no. 2, against which an appeal was preferred, which came to be rejected on 04.02.2026 on the ground of delay. 11.
A bare perusal of the order impugned would reveal that the same though is of two pages, but there is no consideration of the ground taken in the memo of appeal for condonation of delay, once a ground is taken, tenable or untenable in entirety, which has not been done. Since a statement has been made by the learned Standing Counsel that the matter may be remitted back, thus, without delving further into the issue, the petition is being decided in the following terms:- (i) The order dated 04.02.2026 passed by Additional Commissioner, Grade- II (Appeal), Zone-1, State Tax, U.P., Prayagraj / third respondent is set aside. (ii) The matter stands remitted back to the authority to consider the appeal including the delay condonation application and to pass orders in accordance with law within a period of two months. 12. Needless to point out that this Court has not gone into the merits of the matter and all questions are left open to be decided by the Appellate Authority. 13.
