ORDER Date : 08.09.2026 Heard Mr. P. Bordoloi, learned counsel for the petitioner. Also heard Mr. P. Borthakur , learned Additional Public Prosecutor for the State.
2. This application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereby the petitioner, namely, Ramesh Gupta, has prayed for granting pre-arrest bail, apprehending arrest in connection with Jamuguri P.S. Case No. 59/2026 (corresponding to GR Case No. 806/2026) under Sections 318(4)/316(2) of BNS, 2023.
3. It is submitted that the informant had instituted a case against the present petitioner under NI Act in respect of a cheque issued by the petitioner for Rs.6,00,000/- which was dishonored but surprisingly, the petitioner also lodged an FIR on 22.06.2026 at Jamuguri PS alleging misuse of this cheque with an intention to fraudulently withdraw Rs.6,00,000/-
4. It is submitted that the said FIR has evidently been lodged to build up a defence in the aforesaid case under the NI Act which is proceeding before the learned Magistrate.

6. It appears that pursuant to the interim protection granted by this Court, the petitioner had appeared before the IO and his statement

7. Having regard to the above as well as the nature of allegations, the prayer for pre-arrest bail is allowed. The order of interim pre-arrest bail dated 22.07.2026 is thereby made absolute.
8. Accordingly, the anticipatory bail applications stands allowed and
