Instant misc. petition under Section 528 of BNSS is filed for fair, proper, impartial and expedite investigation in relation to FIR No. 155/2025 dated 12.03.2025, registered at Police Station Sewar, District Bharatpur for offence under Sections 108, 318(4), 316(2), 338, 336(3), 115(2), 126(2) & 61(2) of BNS, 2023. 2. Learned counsel for petitioner submits that the petitioner complainant has filed a report against named accused explaining their acts, but police has not investigated the matter, fairly and impartially. He also submitted that the complainant has also filed the representation to the Superintendent of Police, Bharatpur, but same has not been [2026:RJ-JP:34340] (2 of 3) [CRLMP-5246/2026] considered by the Superintendent of Police. He also submitted that the complainant has filed an application under Section 210 of Cr.P.C. and the trial court has called status report, which also indicates that investigation is pending, at Police Station level. 3. Learned public prosecutor submits that the misc. petition may be disposed of at this stage and he assured that matter may be investigated in fair and impartial manner. 4. Having considered submission of learned counsel for petitioner and learned public prosecutor, the misc. petition is disposed of with following directions: (i) the petitioner shall make a representation to the Superintendent of Police, Bharatpur along with a copy of this order, raising all grounds on which the petitioner need investigation. (ii) Learned public prosecutor is directed to ensure that a copy of this order be sent to the Superintendent of Police, Bharatpur. (iii) In case any representation is not filed by complainant, 30 days even then the Superintendent of Police shall consider the points raised by complainants in her complaint along with representation submitted on earlier occasion and will ensure that the investigation is carried out in expeditious manner, but fairly and impartially. (iv) After concluding investigation within a period of three months from now, the police shall submit its report to the concerned court, under intimation to the petitioner.
