3. On the oral prayer made by the Petitioner appearing in person, Municipal Corporation of Delhi (“MCD”) is impleaded as Respondent No.3.
4. The Petitioner shall file the amended Memo of Parties during the course of the day.
5. Heard the Petitioner appearing in person, Mr. Sameer Vashisht,
learned Counsel appearing on behalf of Respondent Nos. 1 and 2 and Mr. Tushar Sannu, learned Counsel representing Respondent No. 3. 6. The present Public Interest Litigation has been filed with a prayer to issue a direction to the Respondents to take necessary steps for removal of garbage and waste dumbed in front of Central Jail No. 3 and other areas within the Tihar Jail Complex. Mr. Sameer Vashisht, learned Counsel representing Respondent Nos. 1 and 2 has submitted that Deputy Superintendent (LO/AO Branch), Prisons Head Quarters, Tihar has already written a letter dated 28.07.2026 to the respective authorities of MCD requesting therein for arranging the immediate removal of garbage around the Field Regulating System (“FRS”) installed at Tihar Jail premises. The said letter also mentions the accumulation of such waste material in the vicinity of FRS poses a potential of fire hazard and compromises the safety norms. The letter dated 28.07.2026 is taken on record. Prior to that letter, various other letters dated 18.03.2026, 20.03.2026, 09.04.2026 and 10.07.2026 were also written by the jail authorities to the MCD. These letters are also taken on record. Copies of these letters have also been provided to Mr. Tushar Sannu, learned Counsel for Respondent No. 3 / MCD. 8. Accordingly, having regard to the facts of the present case and keeping in view that a request has already been made by the jail authorities for removal of garbage and other waste material to Respondent No. 3 / MCD, we dispose of the present Petition with a direction to the concerned authorities of Respondent No. 3 / MCD to immediately act upon the said letters and to take appropriate and necessary action, which may be warranted for removal of garbage and other waste material from the premises of Tihar Jail. The concerned authorities of Respondent No. 3 / MCD shall act forthwith in compliance of this Order and remove the garbage and other waste at the earliest or within two weeks from today. 9. The Writ Petition stands disposed of with the aforesaid observations / directions. This is a digitally signed order.
