respondent-MCD that respondent-MCD had passed four different orders revoking sanctioned plans of four separate buildings, however, against the said revocation orders, appeals have been preferred before the Appellate Tribunal - Municipal Corporation of Delhi [‘AT-MCD’] which are still pending and an interim order has also been passed providing therein that no coercive action shall be taken against the properties involved in the said appeals. 4. Since the order revoking the sanctioned building plan is subject matter of an appeal where an interim order has been granted, at this juncture, unless the said appeal is decided finally, no direction as has been sought in this writ petition can be granted and, therefore, continuance of the proceedings of this writ petition will not serve any purpose. 5. Accordingly, the instant writ petition stands disposed of. 6. We, however, provide that if any cause of action arises or survives after disposal of the appeals by the AT-MCD, it will be open to the petitioner to take recourse to any remedy which may be available to him under law for seeking redressal of his grievances, including filing of a writ petition before this Court. 7. We may make it clear that we have not made any observation as to the merit of the claims of the respective parties.
