The FIR, in connection with which the petitioner was arrested and put behind the bars since 25.08.2026, was lodged by one, Shyam Charan Moulik, stating inter alia that, there was already a dispute between him and the accused person over use of a road and that on 23.08.2026, i.e. the date of lodging the Ejhar, Accused No. 1 arrayed as such in the FIR by carrying a sharp dao, in hand tried to assault the wife of the informant and that during the endeavour to safe his wife, the informant got injured. It was also stated that the Accused No. 1, had also assaulted him due to which, he sustained injuries. In the said FIR, the petitioner was arrayed as Accused No. 2. 4. Mr. S. C. Biswas, the learned counsel for the petitioner, submits that, there were no grievous injuries on the alleged injured person and that, only laceration was found in the forearm of the informant. He submits that no allegation is made against the petitioner in the FIR. 5. On the other hand Ms. S. H. Bora, learned APP, by showing the forwarding report had stated that, the petitioner was also involved in the assault made on the informant and his wife and she prays for calling of the Case Diary. 6.
Upon consideration of the submissions made by the learned counsels, more so, in view of the fact that, no Overt Act in respect of the petitioner was mentioned in the FIR, this Court deems it fit to enlarge the petitioner on bail on furnishing of a bail bond of Rs. 20,000/- (Rs. Twenty Thousand) with one local surety of the like amount to the satisfaction of CJM, Dhubri, under the following conditions:
Page No.# 3/3 (i) The petitioner shall positively appear before the Investigating Officer as and when call for. (ii) The petitioner shall not hamper and tamper with the evidence of the case, and/or influence the witness connected with the case; and (iii) The petitioner shall not leave their residence without prior permission of the Investigating Officer. 7.
